Terms of Service

These terms are an agreement between you and RADLAB LLC, a Wyoming limited liability company ("RADLAB", "we", "us"), for the Pingworth apps and pingworth.ai (together, "Pingworth"). By creating an account or using Pingworth, you agree to them. If you don't agree, please don't use Pingworth.

1. What Pingworth is

Pingworth is a ledger for gig drivers. It compares the offers you receive with what you are actually paid, works out your earnings per hour and per mile across the apps you drive for, and keeps records of your expenses and mileage.

Pingworth is independent. It is not affiliated with, endorsed by, or sponsored by Uber, Lyft, DoorDash, Grubhub, Instacart, Amazon or any other platform. Their names appear only to identify where your data came from.

2. Your account

You must be at least 18 years old. Give us accurate information, keep your password to yourself, and use one account per person. You're responsible for what happens under your account. Tell us promptly if you think someone else has accessed it.

3. Pingworth Pro, billing and cancellation

• Pingworth is free to use. Pingworth Pro is an optional subscription, currently offered monthly or yearly. The yearly plan may include a free trial. The exact price in your currency is shown in the app before you buy.
• Pro is sold and billed by Apple (App Store) or Google (Google Play). Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. If you're in a free trial, you're charged when the trial ends unless you cancel before then.
• You manage and cancel Pro in your App Store or Google Play account settings. Deleting the app or your Pingworth account does not cancel the subscription by itself.
• Refunds are handled by Apple or Google under their policies. We can't issue refunds for store purchases directly.
• If we change the price, your store will notify you in advance as its rules require. The new price applies from your next renewal.

4. Numbers, estimates and tax figures

Pingworth calculates from the data you give it: imports, screenshots, notifications you let it read, and entries you type. Its numbers are only as complete and accurate as that data.

• Tax worksheets and estimates are not tax advice. Schedule C figures, mileage deductions and "tax saved" estimates are informational estimates using published IRS rates. Check them against your own records and your platforms' tax forms, and consult a tax professional before filing. You are responsible for your tax returns.
• Offer grades are not instructions. Accept, borderline and decline labels apply your own targets to the offer details. The decision is always yours.
• The AI copilot can be wrong. Its summaries, offer explanations and tax answers are generated by an AI model from your numbers. Check anything important before you rely on it, and treat its tax answers like the rest of Pingworth's tax figures: estimates, not advice.
• Automatic mileage is an estimate. Distances measured by your phone's GPS can be off, and a drive can be missed or split. Review your drives and keep your own mileage log as the tax rules require.
• Pay comparisons are records, not claims. Pingworth can show you trips that paid less than the offer you accepted, and let you export that table. Anything you send to a platform, you send under your own name, and you are responsible for its accuracy. Pingworth does not act for you with any platform, and it does not guarantee any adjustment.

5. Use Pingworth safely

Don't operate Pingworth while you're driving. It's designed to be set up and used while parked. Follow traffic laws and your platforms' rules at all times. You're responsible for how and when you use your phone in a vehicle.

6. Your platforms' rules

You're responsible for making sure your use of Pingworth fits the terms of the gig platforms you drive for. Pingworth works only with information you choose to give it, such as your own data exports, screenshots you share, and (on Android, if you turn it on) offer notifications on your own phone. It never logs in to your platform accounts.

7. Acceptable use

Don't use Pingworth to break the law. Don't upload anything you don't have the right to use. Don't attempt to access other people's data, probe or disrupt our systems, reverse-engineer the apps except where the law allows it, or resell Pingworth.

8. Your data is yours

You own your ledger. You give us permission to store, process and display it only to run Pingworth for you, as described in the Privacy Policy. This permission ends when you delete your data or your account, except for copies in backups, which roll off as the Privacy Policy describes.

9. Our stuff

Pingworth's apps, code, design, name and logo belong to RADLAB. We give you a personal, non-transferable licence to use the apps under these terms.

10. Disclaimers

Pingworth is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Pingworth will be uninterrupted or error-free, or that its calculations, parsing of offers, or estimates will be correct in every case.

11. Limitation of liability

To the fullest extent the law allows, RADLAB will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost earnings, tax penalties, or decisions you make based on Pingworth. Our total liability for any claim relating to Pingworth is limited to the greater of the amount you paid for Pingworth Pro in the 12 months before the claim, or US$50. Some places don't allow these limits, so they may not all apply to you.

12. Indemnity

You agree to defend and hold RADLAB harmless from claims that arise from your misuse of Pingworth, or from your breach of these terms or of your platforms' terms.

13. Ending things

You can stop using Pingworth and delete your account at any time. We may suspend or close an account that breaks these terms or puts other users or our systems at risk. We'll tell you why unless the law or safety prevents it. Sections 4, 8 (for backups), 10, 11, 12 and 14 survive.

14. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws rules. Courts located in Wyoming have exclusive jurisdiction, unless the law where you live gives you the right to bring a claim locally.

15. Changes

We may update these terms. We'll change the date at the top, and for material changes we'll give you notice in the app before they take effect. If you keep using Pingworth after that, you accept the updated terms.

16. Apple-specific terms

If you got Pingworth from the App Store, these terms are between you and RADLAB, not Apple. Apple has no obligation to provide support or maintenance for Pingworth and is not responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple's standard licensed-application end user licence agreement also applies to your use of the app.
